A trade-mark is a distinctive sign of some kind which is used by a business to identify itself and its products and services to consumers, and to set the business and its products or services apart from those of other businesses.	ट्रेड-मार्क एक प्रकार का विशिष्ट चिह्न होता है जिसका उपयोग किसी व्यवसाय द्वारा उपभोक्ताओं के समक्ष स्वयं की तथा अपने उत्पादों और सेवाओं की पहचान कराने के लिए किया जाता है, तथा व्यवसाय और उसके उत्पादों या सेवाओं को अन्य व्यवसायों से अलग करने के लिए किया जाता है।
Conventionally, a trade-mark comprises a name, word, phrase, logo, symbol, design, image, characters, logo, a domain name, a colour applied to a surface or a combination of one or more of these elements.	परंपरागत रूप से, एक ट्रेड-मार्क में नाम, शब्द, वाक्यांश, लोगो, प्रतीक, डिजाइन, छवि, वर्ण, लोगो, डोमेन नाम, किसी सतह पर लगाया गया रंग या इनमें से एक या अधिक तत्वों का संयोजन शामिल होता है।
There is also a range of non-conventional trade-marks which do not fall into these standard categories.	इसके अलावा अनेक गैर-परम्परागत ट्रेडमार्क भी हैं जो इन मानक श्रेणियों में नहीं आते।
The function of a trade-mark is to serve as an exclusive identifier of the source or origin of a product or service.	ट्रेड-मार्क का कार्य किसी उत्पाद या सेवा के स्रोत या उत्पत्ति के अनन्य पहचानकर्ता के रूप में कार्य करना है।
"Because the purpose of a trade-mark is to distinguish the wares/services of a person by associating the wares/services with a single source, the trade-mark must be distinctive and remain distinctive of the single source." A trade-mark owner seeks to enforce their rights or interests in a trade-mark by preventing unauthorised trade-mark use.	एक ट्रेड-मार्क स्वामी, ट्रेड-मार्क के अनधिकृत उपयोग को रोककर, ट्रेड-मार्क में अपने अधिकारों या हितों को लागू करना चाहता है।
For a trade-mark to be in "use" it must have public "impact".	किसी ट्रेड-मार्क के "प्रयोग" में रहने के लिए उसका सार्वजनिक "प्रभाव" होना आवश्यक है।
As such internal company documents, such as letterhead, memos, reports, etc. are not sufficient unless they are used in outside correspondence.	ऐसे में कंपनी के आंतरिक दस्तावेज, जैसे लेटरहेड, ज्ञापन, रिपोर्ट आदि तब तक पर्याप्त नहीं होते जब तक कि उनका उपयोग बाहरी पत्राचार में न किया जाए।
