| Desde el máximo respeto a las competencias de las Comunidades Autónomas, esta ley se fundamenta en los números 6, 11, 13, 14 y 21 del apartado primero del artículo 149 de la Constitución Española y en la reiterada doctrina del Tribunal Constitucional, manifestada en numerosas sentencias, entre las que cabe destacar, la número 163/1994, de 26 de mayo, que declara la existencia de una competencia estatal en materia de juego que ha de ser ejercida por el Estado en nombre del interés general, sin perjuicio de las competencias que en materia de juego tienen reconocidas las Comunidades Autónomas en sus respectivos Estatutos de autonomía |
With the utmost respect to the competences that pertain to the Autonomous Communities, this law is founded upon sections 6, 11, 13, 14, and 21 of the first section of article 149 of the Spanish Constitution and in the continual doctrine of the Constitutional Court, which has been declared in numerous rulings, among which we can remark ruling number 163/1994 from 26 May, which declares the existence of a national competence in matters of games of chance which is to be exercised by the State in on behalf of public interest, without prejudice to the competences in matters of games of chance that are recognized as pertaining to Autonomous Communities in their respective autonomy Statutes. |
| La regulación de los juegos de ámbito estatal se ha plasmado de conformidad con el mandato recogido en el apartado sexto de la disposición adicional vigésima de la Ley 56/2007, de 28 de diciembre, de Medidas de Impulso de la Sociedad de la Información. |
The regulation of games of chance of a national scope has been done in conformity with the mandate recorded in the sixth section of the twentieth additional provision of Law 56/2006 from 28 December, on Measures for the Development of an Information Society. |
| Las competencias estatales en materia de juego han de ser entendidas, no obstante, sin perjuicio del reconocimiento pleno de las competencias que, en esta materia atribuyen los Estatutos de autonomía a las respectivas Comunidades Autónomas lo que ha hecho preciso el diseño de procedimientos y mecanismos de coordinación entre el Estado y las Comunidades Autónomas. |
The national competences in matters of games of chance must be understood, however, without prejudice to the full recognition of the competences that, on this matter, the Autonomy Statutes attribute to each respective Autonomous Community, which has made it necessary to design procedures and methods of coordination between the State and the Autonomous Communities. |
| A estos efectos, se crea el Consejo de Políticas de Juego, como órgano colegiado que asegurará la participación de las Comunidades Autónomas en la fijación de los principios de la normativa de los juegos y de las medidas de protección a los menores, personas dependientes. |
To this effect, the Council of Gaming Policies shall be constituted as a collegiate organization that shall ensure participation of the Autonomous Communities on the establishment of principles for the regulation of games of chance and of measures for the protection of minors and people with gambling addictions. |
| En todo caso, a través del Consejo de Políticas de Juego se coordinará la actuación del Estado y Comunidades Autónomas en materia de otorgamiento de licencias. |
In any case, through the Council of Gaming Policies, the actions of the State and the Autonomous Communities shall be coordinated on the matter of the granting of licences. |
| Esta ley establece la regulación de las actividades de juego que se realizan a través de canales electrónicos, informáticos, telemáticos e interactivos y en las que los medios presenciales deberán tener un carácter accesorio, salvo las actividades presenciales de juego sujetas a reserva desarrolladas por las entidades designadas por la ley que, por su naturaleza, son exclusivamente de competencia estatal. |
This law establishes the regulation of gambling activities that take place through electronic, computerized, telecommunications-related or interactive media and for which physical presence must be of an incidental nature, except for those gambling activities requiring the physical presence of participants but subject to reservation and developed by the entities designated by law which, by their very nature, fall under the exclusive jurisdiction of the State. |
| Con la finalidad de respetar íntegramente las competencias de las Comunidades Autónomas sobre el juego presencial, la ley ha introducido la obligación de que las Comunidades Autónomas emitan preceptivamente un informe sobre las solicitudes de títulos habilitantes que puedan afectar a su territorio. |
With the aim of completely respecting the competences of the Autonomous Communities over gambling activities requiring physical presence, this law has introduced an obligation for Autonomous Communities to mandatorily issue a report regarding requests for operating licences that could affect their respective territories. |
| La concesión de cualquier título habilitante exigirá, para la instalación o apertura de locales presenciales abiertos al público o de equipos que permitan la participación de los juegos, autorización administrativa de la Comunidad Autónoma, que se otorgará de acuerdo con las políticas propias de dimensionamiento de juego de cada una de ellas. |
The concession of any operating licence will thus require, for the installation or for the opening of premises open to the public or equipment destined for participation in games, an administrative authorization from the respective Autonomous Community, which shall be granted according to the policies of gambling dimensioning established by each of them. |
